Advice please - Spouse visa

Post by elawadi » Thu Apr 27, 2017 10:56 pm

Hi,

First I've been using this site since 2007, never asked a question as I always I find my answers on the forum.
But this time I'm a bit stuck and I need a bit of guiding please.

Long story short :
1- I hold ILR visa since 2008.
2- My fiancé and 2 years old son entered UK on September 2014.
3- Married, applied for Spouse Visa and granted on 11-02-15
4- I applied for nationality and received my British passport on May 2016
5- blessed with daughter on May 2016, she received her British passport May 2016.

Now to the questions

1- My wife and kids are travelling abroad and will back one month before the visa expires, will this cause a problem at the airport?

2- When we apply for renewal should my wife pass A2 level English exam, I just seen this today STATEMENT OF CHANGES IN IMMIGRATION RULES
Introduce a new English language requirement at level A2 of the Common
European Framework of Reference for Languages for applicants for further
leave in the UK as a partner or parent, after completing 30 months here on a 5
- year route to settlement under Appendix FM.

3- When it is possible to apply for my 4yrs old son naturalizations, should this be using form MN1 after he complete 3 years in the UK or I should get ILR first after the 5yrs route with his mother.

If I can use form MN1 what should be the answer in section 1.1?

Thanks a lot I would appreciate any help

1. No issue as long as they return to the UK before their visas expire.

2. Yes, she needs A2 English if applying after 1st May.

3. He needs ILR if born abroad. He will follow the same route as his mother.

@CR001 Thanks for your great help.

We booked fast track visa on Monday and I'm very confused. Do I have to fill separate application for my Child (4 years old) or he is already included in his mother application? should I only copy section 5 and attach it to my wife application? can you please advice?

Thanks in advance
