Refused Tier 2 Visa, Can I still work?

Post by james84 » Sat Apr 29, 2017 2:32 pm

I'm a nurse and was sponsored by a hospital 2 years ago and my current visa will expire in Dec 2017. Another hospital had given me a higher post, so they gave me a Certificate of Sponsorship (CoS) to be used for Tier 2 visa application. I applied for the visa (standard) which is 6-8 weeks and at the same time I gave my notice (6 weeks) to my current hospital. Aiming that by 6 weeks after I finish my notice period I will receive my visa as well. after 6 weeks, I received my visa, but to my surprise it was refused. The reason was, the hospital did not properly advertised the post to a relevant website online. The hospital will re-advertise the post again which will take 28 days.
The Situation: I was left without job while waiting for the CoS to be re-advertised again, then I have to re-apply for the Tier 2 visa again (6-8 weeks).

Question: Can i work while waiting for my CoS???

Many thanks

No, you cannot work as your previous employer would have notified HO that your employment has ended and your current visa will be curtailed/cancelled.

Also, on Tier 2 General, you are only permitted to work for your sponsor so you cannot work for anyone else.

It is never a good idea to resign unless you have your new visa in place.

And you've been pre-selected too, making the RLMT process here a sham.
