Tier 2 Change of Employer

My partner is in the UK on a Tier 2 (General) visa and is switching to a new employer, also on a Tier 2 (General) visa. Does he need to leave the UK to apply for this? It doesn't make sense for him to do this as he has a job here and there is no gap in employment.

Any help would be appreciated!

No he does not. He can apply within the UK provided ALL the proper RLMT has been done.

Suggest he not resign from his current job until he has his new visa.

Hi, you mentioned the Resident Labour Market Test has to be done by the new employer t. Can the applicant be exempt from this if he/she has graduated from within the UK.

I graduated in Nov 2015, been on Tier 2 since then. I am now moving to a new employer but wasn't sure if they have to show RLMT process.

If you could respond as soon as possible, that'd be much appreciated! :)

The RLMT process is mandatory.

As Casa says, RLMT is mandatory. You are only exempt IF you are switching from Tier 4 to Tier 2 and NOT from Tier 2 to Tier 2.

Thanks for your reply. Once the RLMT has been done and the certificate of sponsorship has been issued, how long does it take for the visa application to be processed? I am just looking for a rough timeline.

In majority of the cases, It will take some where between 3 to 6 weeks if you apply by post

If you ( or employer) is ready to pay extra, then priority postal applications only take 10 working days
