Convert Tier 2 ICT Short term to Tier 2 General

Post by madhumca16 » Mon May 01, 2017 10:00 pm

Hello,
Last May, my Indian employer sponsored Tier 2 ICT Short term visa & its going to expire in next few weeks. Recently I got an opportunity from UK based employer & they are ready to sponsor Tier 2 General visa. On completion of my current visa, planning to resign to Indian employer and join with UK based employer, travel back to the UK with Tier 2 General visa.
Could you please help me out, whether I can switch the company to get fresh visa, any cooling-off period will applicable (bearing in mind that Tier 2 ICT short term visa no longer exist).
Just in case if cooling-off period applicable, could you please suggest alternate option to get fresh visa. Thanks in advance.

You will be subject to the 12 month cooling off period regardless of the ICT short term no longer being available.

There is no alternative unless you have a spouse who can get a Tier 2 general visa and you apply as PBS Dependent.

You cannot switch sponsors within the UK on ICT. The requirement for ICT is that you must have worked for the foreign sponsor for 12 months in your home country.

The advice has not changed since you posted the same question yesterday.

In addition to the responses above
You can move to home country and to a new employer who can sponsor Tier 2 ICT without 12 month cool off period provided the proposed salary is >=£73,900
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Sorry. My bad, I think the cool-off period still applies even if your new employer pays >=£73,900
Only the requirement on 12 months prior employment with the sponsorer is waived off
