Failed surinder singh - what to do

Just wondering what to do after failed surinder singh.

We have a british child and in process of making a flr fp application. Im worried that since my wife gave birth through nhs and wasnt billed they will now refuse under 320 (11).

Also i made a child tax credits claim and was told i need to make a joint claim even though my wife had no status yet. We entered with an article 10 residence card.

Will this affect us too?

Why did the SS route fail?

When did you return to the UK on SS route?

What have you been doing in the UK since you returned?

Child tax credits MUST be claimed in JOINT names. Not doing so when you are married and claiming a single is fraud.

Return last year only to be thrown with new regulations.

Refused for not exercising treaty rights and circumventing the law.

Appeal coming soon and all i can rely on is eind case law since i only started working after the refusal.

Im so gutted.

Should we have paid for NHS? cause NHS were fine with it and never billed us either.

Wife gave birth during first 3 months of arrival on a Irish 5 year residence card. Stamp4Eufam.

Also we received nhs tax exemption cards.

How does this work if she is not entitled to NHS?
