Benifits Related

Post by gbpmatrix » Sat May 06, 2017 6:58 pm

Hello,
It has been very helpful in past. I got very valuable and professional advise here. I need some more info now, as I am bit confused. If pos could someone plz help me.
I got my ILR(10 YRS) recently and applied for my wife FLR(M) which is also approved. Financial requirement was my salary 18000. As my salary was 24000 it was not a problem at all. My wifes visa says NO PUBLIC FUNDS.
I have one son and waiting for his BP. My employer is making redundant to my current position but offering me another position- salary is very low. I have no option but to accept the new position. My landlord has given me notice aswel. So I have to find new place for accommodation. My current place was very cheap. Looking at the conditions it looks like it will be bit difficult to manage financially. However I started to apply for jobs.
My question is Will i be able to claim any benefits. If so which ones.

Plz note My wife visa says no public funds.

Will claiming benefits have any impact on my wifs future application.

My wife will be completing her 10 yers next year. She will probably apply for ILR 10 YRS. wILL claiming benifits affect her application.

I May also apply for BP next year. Is it ok to claim benefits.

Yours advise and suggestions will be appreciated.

Thank you
Kind Regards

What's BP? Do you mean British citizenship?

What is your son's current status in the UK?

You will first have to submit a MN1 application for your son (Certificate of Registration as a British Citizen) and once approved you can apply for his British passport. The Registration fee is currently £973 with an additional fee for the passport.

Also in your case, you will only qualify for a British passport once your BC application has been approved and you have attended your citizenship ceremony.
(current fee £1282)

You can claim Child Benefit in your name only. Child Tax credits MUST be claimed in joint names.

(By the way, the minimum income level for FLR(M) is currently £18,600, not £18,000)

My question was about benefits. as my wife is on spouse visa and her visa says no public funds.

""" My question is Will i be able to claim any benefits. If so which ones. Child Benefit in your name. WTC & CTC in JOINT names. Housing Benefit as a single person with child.

Plz note My wife visa says no public funds.

Will claiming benefits have any impact on my wifs future application. Not if claimed in your name

My wife will be completing her 10 yers next year. She will probably apply for ILR 10 YRS. wILL claiming benifits affect her application. Not if you claim as I've advised.

I May also apply for BP next year. Is it ok to claim benefits. Yes as above. Note that you can't apply for a British passport (BP) until you are a British citizen. They are completely different applications.

Pls advise on this .

Kind regards

You're not irritating me...the forum is here for members to ask for help with immigration related issues they're not clear on.

Working Tax Credits and Child Tax Credits are calculated on the household's income, which is why any earnings your wife may have will be included (even though she has no resource to Public funds). The link below will enable you to confirm whether you are able to claim and how much you are entitled to.

https://www.gov.uk/tax-credits-calculator

Housing Benefit is awarded to someone who has a low income in able to assist them with rent. You can only claim as a single person with child.

Thank you Casa,
It means I can only claim child benefit and and housing benefit,as it will be on my name and it will not effect my wife's future ilr appli. Is that right?

CTC AND WTC will be under both of our names and we cant claim as my wife's visa says no public funds. is that right?

Please let me know if understood this properly.

Kind Regards

CTC AND WTC will be under both of our names and we cant claim as my wife's visa says no public funds. is that right? You CAN claim tax credits as long as you claim in joint names. This is permitted even though your wife doesn't have recourse to Public funds.

Please let me know if understood this properly.

I am very confused. Can pls quote from this HO document where it says about claiming benefits is ok for person who has visa with no public funds.

Appreciate for your time and help.
