Joint Child tax credit claim British + overstayer

We made a joint claim whilst our residence card application via surinder singh was in process which is now refused.

I am british and wife is now overstayer/illegal.

When we made claim i told them i am british and wife has a eea residence card application in process. Few months later we got a large sum of back payment. Wife got NI number beginning with OO with no letter at end. No interview.

Was this legal cause i dont want refusal under 320 (11) when we apply for flr or spouse visa from outside.
