Need to clarify few things please advise

Post by Tinkles » Wed May 10, 2017 4:36 pm

Hi
I came to uk in 2005 on dependent visa to my husband who had ancestrial visa
in 2009 we both again reapplied to extend our stay
they said after 5 yrs we both can apply for ILR so we applied for ILR in 2010 and we both have ILR from july 2010 now it is 2017 .
we both got divorced in 2012 out of mutual agreement in UK court. (Doemstic voilence and alcohol issues from beginning tried hard to live a life couldn't so it ended there )
I dont know where he lives and what he does .
my Question is Can I apply on my own rights ? and should I retain my BRP or should I send them back with AN form which is safe and what is advisable to do , ? will my divorce affect my citizenship ? and in section of martial status should I write single or divorced ? but i dont know his address and certain details or should I leave this blank and should I apply on my own through post or is NCS safe or recommendable .

Can I apply on my own rights ?
Yes, provided you meet all the requirements including absence limit and being physically present in the UK 5 years ago on the date you apply.

and should I retain my BRP or should I send them back with AN form which is safe and what is advisable to do , ?
Depends how you apply, post or NCS. Your card will have to be returned either way as it will no longer be valid.
will my divorce affect my citizenship ?

No
and in section of martial status should I write single or divorced ?
Either, but divorced should be fine.
but i dont know his address and certain details or should I leave this blank
You can write 'details not known'.
and should I apply on my own through post or is NCS safe or recommendable .
Strongly advise you to use NCS. You get to keep hold of all your original documents and you can apply for the JCAP scheme, with is applying for citizenship and passport at the same time. By post you have to send ALL your originals and you only get them back once a decision is made, which can take many months.

Thank You CR001

Yes I have been working in uk since then I have counted all my days it comes to 350 days in the last five years and 60 days in the last 12 months but there is time inside those 5 years where I was ill and was hospitalized in uk and aborad during the year 2012 to 2013 where I had to spent 4 month taking rest to get my legs healed but that was like 140 days spent outside uk that was the highest but still it doesnt exceed the 450 days but do you think they will ask the reasons and letters of the doctor etc why I was outside during that year particularily . Please advise ?

Employment is not a requirement for citizenship, so don't worry about that. As long as you are within your absence limits you will be fine.
