Youth Mobility Visa & Getting Married

My Canadian partner is in the UK on a Youth Mobility Visa, He's visa runs out end of the year and we planning to get married. My Question, We wanted to go Las Vegas and get married then return to the UK, Then apply for him to stay. Would it still be ok to return to the UK on his youth mobility visa or not?

Yes no issues as long as he returns a bit before it expires and applies for a spouse visa before it expires, assuming you meet all the standard requirements.

Can anyone recommend an immigration lawyer who could help us with the spouse visa? I'm uneasy of just picking one from google, hoping someone has used one and can recommend? Thanks

I thought it was best to get an immigration lawyer to help with applying for a spouse visa, maybe I'm wrong. This is all new to me, so not sure really

Unfortunately there have been numerous examples on the forum of members being given incorrect guidance by legal advisors.

You should be able to get all the advice you need for free here on the forum.

Are you able to meet the minimum income level of £18,600 p.a? This can be joint if your fiancee is in employment while on her Tier 5 Mobility visa.

Thank you so much for your help and advice, I'm disabled on disability benefits, DLA/ESA, I was told we're exempt from the income level of £18,600. Maybe we can think about applying for the spouse visa ourselves without a lawyer, that would really help us with the cost.

In which case you will only need to submit evidence of 'adequate maintenance', which unless there has been an increase in April this would be £144 per week after rent or mortgage and council tax have been deducted.

My partner is already working here on youth mobility visa on gross £24k pa (£12 per hour), Do we use his income to prove we meet the £18.600 threshold. or shall we use my disability benefits(DLA) to prove were exempt.

Hmm. Bear in mind that once you are married your wife's income may be used in the calculation for the benefits you are awarded. Others may be able to advise further.
