Maximum number of days outside UK

Post by bbreddy » Thu May 18, 2017 10:34 pm

Hi All,

I would like to clarify the below regarding 180 days rule. I am due to apply for ILR in Nov, 2017 i.e. in 6 months time.

So far I have spent about 8 days outside the work - which is within the limit of '180 days in continuous period'.

My employer has now signed a project with a EU based firm - for which they want me to travel Monday-Friday for the next 6 months.

Will partial days count towards the 180 days? i.e. by travelling Mon-Fri, will it only count 3 days towards the overall 180 days?

Furthermore rules say the below -
"If the absences are connected to other employment outside the UK, which
demonstrates the UK employment is secondary, these are not permitted absences,
and the continuous period requirement is broken. Absences due to employment,
whether related to the applicant’s job in the UK or not, count towards the 180 day
maximum each year
"

and
"You still need evidence where the absences in a 12 month period (as defined above)
exceed 30 working days plus statutory public holidays.

"

What evidence do we need to provide? Please advise as I am told to make a decision to join the project or not asap.

Is there any risk involved for my ILR application? Please suggest.

Many thanks
