FLR Immigration for spouse

Post by aryankshatri » Tue May 23, 2017 3:07 pm

I have British Citizenship/Passport and i am living in UK since 2001.After my marriage my wife lived in UK as well and she got ILR in 2007.Later in 2008 Unfortunately, she has to live in India for more than 2 years and the ILR became invalid.
She applied for Re activation of ILR in India in 2010(it was 25th month outside UK) but was refused. She then applied for dependent visa from India in Sept 2014 and came to UK as a spouse of a person settled in UK in 2014, with a visa valid for 2 and half years which will soon expire. I am self employed, but for the abouve visa application i prefered to meet the financial requirement as a salaried employee for my own company.
We have 2 kids and both hold British passport. We live in our own house which is on a mortgage.

My wife is now applying for visa extension and using FLR(M) form. She has also passed the English exam and ready to apply. I have a question about the financial requirement.

Since she was granted ILR in the past, which was before July 2012, do i still need to meet the financial requirement?
18,600 GBP limit is for sponsor er salary alone or can be salary of husband, wife(sponserer and applicant) combined? For some reasons i had to take holidays from January 2017 to April 2017, so i am finding difficult to show the income for last 4 months.but i had consistent income since 2013 as an employee of my own company(Self employee).
Your advice is appreciated.

Kindly advice.
Many Thanks

Forget about pre July 2012, it is no longer valid for her. She is under the new rules and you need to meet the financial requirement and she must meet English A2.

Either or combined income can be used.

Financial Requirement

Post by aryankshatri » Wed May 24, 2017 1:32 pm

Hello

I am applying for the extension of Spouse Visa for my wife and i am the sponsorer. I am the director of my company ZZZ and entitled to dividends and my wife is director for the same company ZZZ entitled to DIvidends. Last financial year there was no billing due to certain reasons basically health problems.
Before that in the financial year 2015/16 and 2014/15 the Company ZZZ was in Sound position.
The salary and dividends we withdrew from the company in last financial year 2016/17 was only 15000.

Is there any way i can meet the financial requirement based on the above facts. In the past My wife also have a Permanent residence (ILR) stamped on passport but it was inactivated as she stayed outside UK for more than 2 years. I have two kids, both are British Passport holder.

Advice is much needed and appreciated.
Many Thanks
