Child Born to Parents on ILR

Post by manch221 » Wed May 24, 2017 5:02 pm

Hi
My friend and his wife got ILR in November 2016 and they had a child born in December 2016.
Question is that do they need to send Form MN1 for the child ? Or they could just simply apply for baby British Passport?
Thanks

Hi,
Your friend can apply for British passport for his baby as he was already settled in the UK before the birth of the child.

If child was born in the UK -> apply for a British passport.

If child was born abroad -> apply for ILE and register child as British using Form MN1 when one parent naturalises.

Slightly different.

If child was born in the UK -> apply for a British passport.

If child was born abroad -> Child would be a family member of an EEA citien with PR and would acquire PR on the same conditions as an adult after five years of residence in the UK.
