section 4(2) BNA 1981.

I was a British Citizen in Malawi before my British Father passed away.
I renewed my passport in 1973 and got back one with British Overseas Citizen because I did not produce my late fathers documents which were being kept safe by the embassy in Malawi.
I came to the UK in November 1979 on a "Quota". My immediate 9 member family are all British from birth, as I was till 1973, And All living in the UK since 1976.
I applied for Citizenship on grounds that my mothr is British. The following is an email I have just received from the Home Office:

You have applied under section 4C of the BNA 1981 however, you have no entitlement to register under this provision as you have no entitlement to the right of abode.

You may however, have an entitlement to registration under section 4(2) BNA 1981.

If you wish to change your application to registration under 4(2) you may do so but you will need to pay a balance of fee of £1041 as this application type holds a registration fee.

Alternatively we can reject the current application and refund the £80 paid and you may submit a fresh application using a BOTA form and supply the correct fee and documentation when you are ready to do so.
Can anyone advise me on this Please

Have you got your years right? The category of British Overseas Citizen was only created in 1983.

Also, give us more of your family history to assist you with. Where and when were your father and mother born? Where and when were you grandparents born? Do you have documentary proof of their births?

Do you have any other nationality/citizenship? Did you acquire Malawian citizenship or any other citizenship at any point of time?
