New A2 English Requirement missed

Post by gozomagic » Fri Jun 02, 2017 7:22 pm

Hi All.

Wondering if someone can help with some pointers.

My wife visa is due for renewal. I already did this. I had researched all last year. And prepped accordingly. We recently moved home so things have been hectic.

Alas. Understand it can take 8 weeks. But i think i applied 2 week too late as wifes visa runs out as of 6 weeks of when i applied. Is this an issue? Will i need to apply for a temp visa in an interim? Read that whilst there is an application it can overlapse?

Second. I have already applied. And today learned of the new A2 certificate rule. I obvioulsy didnt read docs and was adamant that the A1 was all that was required. Since being in UK my wife has gained Gateway Entry Level 3 (speaking, listening, writing) in English and Ascentis Level 1 in ESOL skills for life (speaking & listening, reading) which i understand are higher equivalent. Which i could have included but didnt think was required now feel a wolly. But now application has been made. My cencern is if it will be rejected or delayed due to the lack of A2 or what can I expect.

Should i send my documents in advance ontop what has already been sent as we just got Biometric request. Or should i wait for this request from the home office asking for it first.

Any help appreciated.

Only tests on the list of approved test providers will be accepted. ESOL qualifications can no longer be used.

Had your wife's visa expired when you submitted the application? Your post isn't clear.

Submitting a FLR(M) application more than 28 days before the expiry date of the current visa could result in the need for an additional FLR(M) extension to make up the shortfall before qualifying for ILR.

It's irrelevant how long it takes to process the application as the legal status (Section 3c leave) remains the same while a decision is being made.
