Non-EEA spouse expired Residence Card - entitled to PR?

Post by arielgragnani » Mon Jun 05, 2017 6:42 pm

Dear All,

I wonder whether you could help :

I am an Italian citizen living and working in UK 12yrs +. My wife is American also here for over 12 yrs currently working as well. She had her 5 year residence permit which expired in October 2016. We want to apply now for PR however we are unsure whether she qualifies as we have been told that she should have applied before the residence card expired. Is this true? Also, would I submit the supporting evidence from the last 5 years from now or during the duration of her residence permit?

Many thanks,

Florian

The expiry of a non-compulsory document should have no impact on the decision.

Your choice to pick dates of 5-year qualifying period.
