This is my first post so kindly guide me if I am not following any forum rules.
Immigration History
-Came to UK as a Tier 4 student in 2011.
-Further leave granted as a Tier 4 student from 2014 to 2017
-Leave curtailed in 2015 (Because I used TOEIC test in my application)
-Applied for Judicial review which was refused in May 2016.
-I received a letter somewhere in late 2015 that I am liable to detain but I was never detained and was asked to report every week to a Home Office reporting centre.I did this for around 10 months Sadly I am not doing it since December 2016.
Marital Status
I did a register marriage in UK with a NON EU national in 2014 who was on student visa as well. It was an arranged marriage and lasted only one month and he permanently moved back home in 2014. I applied divorce in October 2016 and its under process.
Current Family life and circumstances
My husband now is a British National, we met in September 2016. We got married (Religious marriage only) in December 2016 and are living together since than. He earns more than £18600 and was never married before.
Please help and advice
Now I wish to regularise my stay as I clearly have change in circumstances. I have been advised by solicitor that I can apply FLR outside the immigration rules. Than seek permission to perform registered marriage and make an in country application. But I am not sure if it will be an easy path, as a lot of people on this forum are struggling with this scenario.
The second option I have is to go back home and get registered for marriage their and apply for FLR(M). But what I need to know is will this application be straight forward? Keeping in mind my immigration history and use of TOEIC test. I do not want a scenario where me and my husband can not live together and wait for months for the decision. Because he runs a business here and can not leave the country permanently.
