Tier 1 dependent extension visa refusal

Post by jimohaliu56 » Sat Jun 10, 2017 7:25 am

Morning all,

New to this forum but I need advise on what to do pleaseeeee.

My wife's application has just been refused due to a silly mistake by myself. I submitted her application with maintenance fee of £630 deeping to £66 for just one day. I know the rules says 90 days and it's my fault. We have not been given any chance to appeal but were given chance for administrative review. Reading the administrative review rules, I know I don't have a chance because case worker made no error, spotted the mistake. They also considered section 55 for child welfare. We have recently had our child shortly before application but felt no need to inform them as I did not feel the necessity.

I have an account that I can present to them with more than enough fund for over 200days but again, did not include it.

Please can someone please advise on what I should do next? It is burning my heart, its my fault. Please someone help me.

We're you give the option to make another application within 14 days and AR of only AR option?

When did you get the decision letter and what is the date of letter?

Why did you not submit the other statement just to be safe if you knew you had dropped below the required maintenance level?

What is your current immigration status?

The only option given was to apply for AR.

I received the letter on 8th June 2017 but was written on 6th June 2017.

In hindsight, I would submitted both. I had it in my mind that i submitted both. Silly silly mistake.

I have my ILR now. Which was issued on 20th April 2017 and my wife's application was made on the 29th April.

Please somebody help advise on what to do? CR001....

You could try reapply with the other statement as it is within 14 days or submit an AR to buy some time.

Hi
I have some how the similar case as of @jimohaliu56
My case is
I submited my wife visa extension application on 04th may 2017, I got the refusal on yesterday 10 june and the reason they are saying is that the maintenance funds does not cover the 90days period.
I have submitted the statement for last 90 days, however the first 4 days there was no transaction in my account so these 4 days not come in print outs of statement. So my statement starts from 06feb to 02 june (86 days)
Case worker mentioned in the refusal letter that your statement should start from 02feb in order to complete 90 days. They have ask for Administrative review ,
I know this is my mistake and I have not check the no of days.
Can you people guide and help me in the best possible way ????. My wife visa expires on 07 May 2017

Can I reprint the same account statement and mention in my AR.does it acceptable??
Waiting for responses. Thanks

Hi CR001,

Thank you for your message and assistance. I was wondering, since they also considered Section 55 for children, do you think I should add information about our new born child in the AR such as
- birth certificate & photos.

There is no way of attaching document when making an AR application, I was going to send all documents in the post to the case worker in charge and hope that both will arrive at the same time and they can connect the dots...

Please advise???

You cannot submit new evidence or documents for AR. The process of AR is for if HO has made an error and in your case they have not.

I am now going to apply for new application and this time same day
I have another very important question regarding the 14 days period , is it start from the next day when I received the letter
Or it starts from the same day .
I received letter on 10june so 14 days start from 11june to 24june ??????

Appreciate your quick response . Thanks CR001.

I think it is from date of letter, but stand to be corrected.

This is the date when you receive the letter. It is confirmed from Lawyer and other Guidance.

There should be 1 AR Application and the child is automatically added in the review.

I got the AR Refusal as well. The main reason is HO do not accept new evidence as they have to look into the evidences provided in original application.
So now i am going to apply a fresh application with in 14 days .

Please start your own topic and explain the reasons for refusal rather than tagging on it an old topic.

Also please don't post in capital letters, it is the same as shouting.
