Exceptionally complex issues

Post by Bellapham » Sun Jun 18, 2017 11:47 am

Hello everyone,

I am from Vietnam. I and my husband dicided to get married on 21/1/2017, when I was still holding my student visa and it expired on 30/1/2017. We applied for my spouse visa on 26/1. My husband is an architect and he meets the financial requirement. He started his own business in April 2016, so this April will be one year.

After waiting like an ages, We received a letter on 19/4 said that:
" thank you for your application for permission to stay in the UK.
Although we would normally decide your application within 8 weeks from the dates it was submitted, unfortunately this is not going to be possible in your case.
This is because your application raises exceptionally complex issues and we require further time to consider your case thoroughly and reach a decision.
Your sincerely,
..."

So we thought that they might need more time to consider my case. We didn't call or send any letters to ask for my case. But it was nearly 2 months now after the letter and I hasn't still received any other letters or emails from them. We are really worrying now, because my student visa expired long time ago and we have to wait for too long.

Anybody has the same problem or any experiences about this, please help me give soem advices. I'm really grateful for that.

Many thanks,
Bella

What financial evidence did your husband submit?

1. His bankstatement last 6 months.
2. Pay slips for his company.
3. His company's tax return.
4. Dividends.

That's what he can remember.
Thanks.

This may not be sufficient. See the required evidence in Sections 7 & 9 in the link below.

Thanks for your answer.

I do read the link and the sections you suggested. I don't really know exactly in detail what papers he submitted. But if it's not enough, they should send a letter or something to ask more information from us. However, they didn't do anything. So does it mean my visa application will be rejected?

Did you not keep a copy of your application?
(b) The decision maker may contact the applicant or their representative in writing and give the applicant a single opportunity to correct any omission or error which renders the application invalid, save for failure to enrol their biometric information. The amended application and/or any requested documents must be received at the address specified in the request within 10 business days of the date on which the request was sent.

I don't keep a copy of my application. But we did check really carefully all documents before we submitted. My husband submitted all documents for financial evidences they required. They did send 2 letters after we submitted the supportive documents. One is for my husband's picture and one is for my biometric registration. We all did them on time. The last one was the "exceptionally complex issues". I don't know why. Or they suspect our relationship because we got married near the expired date of my student visa?
