Hi All,
I am about to get my ILR, My wife and family are in India and need to apply as soon as i got mine.
My wife came here in 2013 and from that time she been extending her visa, and my daughter applied for entry clearance in 2014 from India, they both still have a valid visa until Jan 2018.

The visa I need to apply for my family is settlement ?
Do I need to pay NHS charge for my daughter?

On what basis are you applying for ILR, 5 year PBS route or 10 years long residence??

Does the sponsor's ILR status have a bearing on the applicant? What if the sponsor is a born and bred British citizen?

A British born spouse no, a spouse on ILR yes.

If the OP got ILR based on long residence, the dependents must apply for a spouse settlement visa. If the OP got ILR based on PBS route, the dependents can continue on their PBS Dependent visas.

If in the UK, they will need to switch to FLR(M) which will reset their clock to zero and a new 5 year residence period (2 X 2.5 year visas). IHS of £500 payable for each dependent plus the visa fee.

VAF4A spouse/child settlement visa if applying from India after you get ILR. £600 IHS each plus the visa fee if £1464 each.

You also have to meet the financial requirement and your spouse needs English A1.

They will only get a 30 day visa and must enter the UK within that time and collect their BRPs once here.

As they are in India they need to apply for a Settlement Visa, paying £600 NHS surcharge per each including child. how long they will get their visa ? is it ILR they are going to get?

IHS is £600 for wife and £600 for child plus £1464 visa fee each.

They will get a visa for 30 or 33 months and will ha e to renew it near the end for another 2 5 years before they will qualify for ILR.

You should note that the visa in their passport will only be valid for 30 days and rhey must enter the uk in theis time and must collect their BRPS cards within 10 days of arriving in the UK.

Because you got ILR based on long residence, your dependents now have to start again from scratch with a new 5 year visa before applying for ILR.
