Working abroad and effect on Spousal visa

Post by Ridaakamran » Tue Jun 20, 2017 3:15 am

Hi guys I have few question it would be really nice if you help me. Question 1
Does the number of days I am outside of the country affect my ability to obtain indefinite leave to remain.
Currently there is conflicting information online. Some suggest that I must remain for at least 270 days of the year in my final year in the UK before applying for indefinite leave to remain (ILR), others suggest the number of days you live outside and within the UK has no bearing on the indefinite leave to remain application. Please can you advice what is the correct position.
I ask this question as my husband has recently moved to Qatar and I wish to live with him but I am confused if this will have an impact on my ILR application.

Question 2
My husband no longer works in the uk and is not a tax payer as he works in Qatar. I do not take any benefits from the UK government and am provided with the necessary finances from my husband and still reside in the same place we shared when he was here with our son. Will my husband’s foreign earnings be taken into consideration when the applying for ILR or is it only UK earnings?

Question 3
In order for me to live in Qatar my husband will sponsor me and apply for a Qatari residents permit to be allowed to legally live there. Will obtaining a residents permit in Qatar affect my ILR application.
I.e. because I am a resident of another country I cannot apply for ILR in the UK?

There is no absence limit if your are in a spouse visa but you and hubby obviously need to reside in the UK. You are confusing the absence requirements with the British citizenship application rules.

You cannot continue staying in a spouse visa if your husband has left the UK and is working and settled somewhere else.

In order for you to qualify for ILR, you are both required to be present and settled in the UK.
