Family Visa for my Chinese wife to UK

Post by Scotty783 » Mon Jun 26, 2017 8:53 am

Hi all, I'm looking for some clarification and advice please,

I'm a British Citizen, 47 years old and have been living and working in China for approx. 13 years. I married my Chinese wife 7 years ago and have a son Luke 7, and daughter Chloe 2.

Both children have British Passports. We are financially very secure, own our own apartment in China and my wife has visited the UK on a visitors visa a few times now.

It is our intention to return to the UK in a year or so and I'm trying to get prepared. I have income from 2 flats in the UK although we will be applying by meeting the savings criteria rather than the income one as I intend to resign from my job in China at the point we wish to leave.

Having gone through circles of the GOV.UK website it seems that we need to apply for a 'Family Visa'. However, this first stipulation is where I am getting confused:

'Your family member must be both:
a British citizen or settled (they have 'indefinite leave to remain')
living permanently in the UK'

Clearly, as we live together in China, I can't say that I 'live permanently' in the UK? and what does that mean exactly? does it mean that I have to return to the UK without my family (for how long?) and setup home, then return to China to help my wife apply, then wait, then return to the UK with the family? or am I missing something?

Any help would be appreciated.

It's misleading, as the HO guidance often is. Assuming you have the equivalent of £62,500, (held in an accessible account for a minimum of 6 months, unless from the sale of property), you will be able to re-locate to the UK together as soon as your wife's spouse visa is issued.

You will also have to show adequate accommodation available on your arrival.

Do bear in mind that she will have only 30 days from the issue date to enter the UK and collect her BRP from a designated Post Office within 10 days of arrival.

Thanks you so much for helping me clear that up - it is indeed misleading and confusing - why on earth can't they make it clearer? :?

Forgive me, but what is the BRP?
