Help extended family refused received Red.0001

Hi every one please help any advice i am not new here not able to sign in so i have to regster again.
Eu citizen brother of my patner and me and 3 kids as dependant first we did apply last year march oct was refused the reason was we did not put our pasport and birth certicate of my patner and his brother.
After apply new pasport and birth certficate plus DNA result, we reaply again after six month refused again the reason this time was the eu sponsor he was not support as before, and we did not provide kids full birth certficate and the sponsor (my brother in law)he send money to my account so they can not accept as we are not married and we over stay.
Then we send pre action letter was refused while prepare to apply judicial review we receive RED.0001 given us 10 days to tell them why we should not remove which we did reply the next day. the red0001 my kids and their father they will remove to his country and me to my country. after respond the Red.0001 i received is96 start sign in next ,on me my patner he has been sign in since 2011.

our story me and my patner we come different country , my patner was in lagacy programe which was refused we went to court was dismiss and refuse permision to upper tear. our kids are 9 years old 6 years old soon will be seven and 2 years old , my self i come as Student over stay since 2009.

My question is that can they detain me and remove with out my kids as i am dependat i do not have any pending application for my self ? always i been under my patner.
