Spouse Visa Extension

Post by Chintz » Tue Jul 11, 2017 4:07 pm

Hello, I am in same boat for extending my visa after 33 months.
My next application is due in March 2018 but as we have six month left I am preparing myself and gathering information.
Need advice for few things
1) For first application in April 2015 which was granted in June 2015 I have submitted A1 test certificate for English language requirement. This time would it be okay to provide UK NARIC letter along with my qualifications? Basically I have a Post Graduate degree in pharmacy in India. And my planning is if the statement of NARIC states that my English level is B1 or more then its easy to save some cost when applying for ILR after 5 years.
Also when I try to create my account in NARIC it is asking for Immigration Tier which is FAMILY, SETTLEMENT and NATIONALITY but for Immigration Route Which immigration route should I select 1) Family 2) Settlement?

2) Although we are living together, our financial are divided at the moment. My wife name is on mortage and for other bills its on my name. Is it necessary to have both names on single utility bill?

3) I am working more than the financial requirement of visa. But my job is temporary. I have been working with same firm for about more than 1.5 years and they extend my contract before it get ends. My current contract ends in April 2018 (one month after my visa expires). I am pretty sure that they will extend my contract before Dec 2017. Will this affect my application?

thanks for advice

kind Regard

Chintan

1. Family

2. Single names is fine, you just need more documents, still over 2 years though.

3. Should be ok. Does your spouse work?

Thanks CR001.
Can you please explain the meaning of selecting Family route and not settlement route? I am sorry but I need to know what is the difference between family route and settlement route in same Tier. .

2) In 2.5 years of staying in U.K. I was living with my in laws for about 1.8 years and then this march 2017 we bought a house and living together so we can pretty much generate 2 years document.

3) Well my wife in bringing me here had worked at that time. She was working as permanant employee. Then after 5 months of my arrival she left that job and started her further studies. At the moment she is self employed as a writer and painter. But that doesn't cover the financial requirement.
We are planning is to keep only my name under financial clause of application. Would that be okay??

Thanks again

Hello all, I have been reading some of your posts and its very sad and pretty upsetting you have to go through all this just to be with your other halves. I've been there and its a nightmare, its like your lives are at a standstill. :-( Now I have done a good amount of research and spoke to numerous TRUSTED legal professionals on the Spouse Visa & Spouse Visa Extension issue. After carrying out this research I have compiled a list down below. Please note I am not an immigration adviser or a legal professional. Please also note that the UK Home Office tend to change their rules regularly so keep a close eye on their website for the current requirements.

•A1 English Language Test for UK Spouse Visa & an A2 English Language Test for a UK Spouse Visa Extension (Please take a note of the Expiry Date of the certificate, it usually lasts about 2 years. The Home Office will reject any applications that are submitted with an expired English Language Test Certificate)

•Marraige Certificate & Translation (Translate all documents that are not in English to English, must be done by a qualified translator)

•Sponsor, Spouse and Childs Birth Certificate & Translations (if you have any documents that are not in English, they must be translated to English by a qualified translator, this includes Birth Certificates, Marriages Certificates and anything else which is not in English)

•Sponsor, Spouse and Childs Passport & Photographs

•6 Months Bank Statements (Please include ORIGINALS, if you do not have the originals please include copies but make sure that they are stamped and signed by your Bank)

•6 Months Wage Slips (Please include ORIGINALS)

•P60

•Employment Letter (on company headed paper) (Letter MUST include the following -
i. Your full name,
ii. Your position within the company you work for
iii. Confirm that you are employed on a permanent basis,
iv. Confirm your employment start date,
v. Confirm the date since you have been on the current rate of pay,
vi. Your annual salary.)

•Financial requirement which is currently £18,600 and will increase to £22,400 if you have a child. Each additional child will increase the requirement by £2,400. If you have any children who are BRITISH, you DO NOT have to meet the increased amount, only the £18,600 will be required. If you are applying for a SPOUSE VISA EXTENSION, you can combine your salaries to meet the financial requirement)

•Tenancy Agreement if you are renting or Mortgage agreement if otherwise

•Skype, Whatsapp, etc. chat logs, phone call logs, (please cover an extended period, not just 1 week, try to cover a few months because the Immigration Officer wants to check that you are in a genuine relationship)

•Family Photos (to prove your relationship is genuine, please include 5 to 10 different ones and please SMILE :-)

•Flight Tickets (again to prove that the relationship is genuine)

•Joint & Single Bills & Letters, i.e, Gas & Electricity Bill, Water Bill, Joint Bank Account Statements, HM Revenue Letter, DVLA Letter, Local Council Letter, Mobile Phone Bills, Single Bank Account Statements or any letter that has your & your Spouses address on it (Please note that this requirement is for those that are applying for the SPOUSE VISA EXTENSION) (Please include as much as you can, also throw in any JUNK Mail that has your name and address on it)

•NHS Surcharge - (please check Home Office Website for the current amount)

•Visa Fees - (please check Home Office Website for the current amount)

•Solicitor Fees - (I would strongly advise you all to speak to a couple of solicitors who deal with Immigration issues. Why I recommend a "couple" is because there are some solicitors out there who just want to rip you off, BE CAREFUL and save your money. Also, if make your application through a solicitor and your application is rejected, it is on the solicitors head, he/she will help you out. Anyways, sorry for going on for so long and the best of luck to you all. I hope everything works.

CAN YOU ALL PLEASE COPY AND PASTE THIS INFORMATION ONTO OTHER THREADS SO PEOPLE CAN VIEW IT.

Hi,

Could anyone please help me with the above query I have?

Also thanks justhelping for this very useful information.

However I have one query from this.

We have to show our 6 months salary slips for the application. Currently I am working as a temps/contract basis. I do get salary slips as locked .pdf files through my emails. I get every week and so for 6 months a lot of papers to gather it.
Is there any specific requirement I need to do based on my situation. Do I have to request any help from my agency? Also for renewal of contract they send me their document which I have to sign and send them back.

Do I need to request them to provide me all the contract from the date I started till today with their stamp?

Thanks for helping

Hi,

Get the original wage slip print outs for each week, then compile it into each month, so roughly 4-5 slips per month. Make sure you mention this in your application, i.e that you get your wage slip every week and not every month. As long as you can prove how long you have been working in your current job, you should be okay. Your employment letter must state the following -
i. Your full name,
ii. Your position within the company you work for
iii. Confirm that you are employed on a permanent basis, (or contract in your situation)
iv. Confirm your employment start date,
v. Confirm the date since you have been on the current rate of pay,
vi. Your annual salary.)

My best advice for you would be to contact a solicitor who deals with immigration. Also get a 2nd opinion, just to be sure.

Best of luck
