County Court Judgement

Hi Everyone, I will be very thankful if you help me in this query. I am filling SET form and stuck on one point which says have you received any court judgement in case of non payment of a debt. I received a letter couple of months ago from a collection agency names XXXXX on behalf of Manchester city council for non payment of bus lane ticket which I didn't receive due to moving to new address. The letter stated the county court traffic enforcement judgement. I have paid that fine after receiving that letter. Do I need to mention that in my SET application. How do I explain that it was not my fault that I didn't receive the first penalty letter and when I received it I paid it. I hope it doesn't destroy my good character qualification. Kindly help and advise. Thanks

As the fine was issued by the court it should be declared. It's unlikely to result in a refusal of ILR, but withholding the information could do.

hi I just had a successful application considering I had 3 CCJ but I declared them all and I was granted indefinite leave. YOU SHOULD DECLARE

I am in simile situation. Have a county court case registered on 7th 7th July and I made payment (in full) on same say. I have got confirmation of payment but it apears in my ccj file. What shall I do? I am going to write a cover letter to explain why it happened because we never received a letter from court so can't fill the relevant sections in form. Please help me if I should do something else? I am really scared and cannot sleep :(

@Sally77 thanks brother. Yes I am going to declare it. They will find it any way so no point of NoT declaring it. Thanks 4 the advise.

@Sara_wales you don't need to write full story. You can write small details there like revived CCJ and Paid fully. Previously no letter revived. And then you can further explain in the current circumstances by writing a short paragraph.

That's what I'm going to do. They will see from credit file that this has been adjusted.

A CCJ might sound scary but it is simply a civil court order against a debtor by a creditor. Simply put, it is merely a legal attempt to force the debtor to pay back the debt. CCJs are issued by county courts which makes them civil matter, not a conviction or criminal offence and they will not appear on your criminal record.
They have no effect on ILR but having a large or unsettled CCJ might affect your citizenship application :!:
If you pay a CCJ in full within 30 days, CCJ will be removed altogether from the register. :idea:

Another question. I just noticed that collection letter from agency mentioned the charges said a warrant has been issued. So I believe that warrant does not mean CCJ. I am just checking my credit report and it says I have no court or insolvency data. Also it says I have no default or repossession. Please explain thus.
2nd question. Can I staple the ILR application forms along with the supporting documents or do i need to send forms without staple or binding etc . What should be the right sequence to send all forms n supporting documents. Thanks in advance

After a CCJ is issued, a creditor can ask the court to send bailiffs to collect the money owed. Please seek legal advice from appropriate channels :!:

No need for binding. Put all of them in a large envelope, suggest to separate each evidence properly and mark them clearly

Thanks guys. My application is approved today. I explained the CCJ issue in my cover letter along with receipt of payment and it was fine.

Hi there,

I was just reading these posts. I applied for ILR under SET(M) in late march 2018.

I had to pay £80.00 fine in August 2017 for putting out cigarette on the street. Do I need to declare that on the form? I haven't declared it on the form. Is it too late to do so?

I done my bio-metric in early of April 2018.

Any suggestions or help ???

As long as you paid it then and there and the fine wasn't issued by a court, it should have no impact and you do not have to declare it.

Yes, I did. I paid it over the phone on the same day I got fined with reference number they given me.
