I have a problem regarding my husband's eligibility for the residence card.
We have heard many opinions about this issue so I decided to ask about it on this forum.
The governmental website ( https://www.gov.uk/apply-for-a-uk-resid ... ligibility ) clearly states that when you're a 'qualified person' then your spouse can apply for the residence card.
" A qualified person is someone who is in the UK and one of the following applies:
they’re working
they’re self-employed
they’re self-sufficient
they’re studying
they’re looking for work (only if they meet certain conditions) "
I am starting my university in September and I thought that our situation is sorted out as my husband can get a residency card when I'm a student. However, we went to see a lawyer and he said that we cannot apply as I am taking out a student loan, which means I am not 'self-sufficent'.
So my question is, is what the lawyer said really true? I mean, on the governmental website it says nothing about me being self-sufficient while studying.
Does taking out a student loan really means that my husband is no longer eligible for the residence card based on my student status?
