Qualifying for ILR but my wife is still on a Tier 2 Dependen

Post by desiwanderlust30 » Mon Jul 17, 2017 2:59 pm

Hi all,

I've gone through the various threads on this forum, but couldn't find the answer to a questions I had.

I qualify for ILR in August 2018, through 5 years on a Tier 2 visa. My wife joined me in the UK in October 2016 on a Tier 2 dependent visa. In regards to this, I had the following Qs:

1. When I apply for ILR in Aug 2018, would my wife need to switch to a dependent of mine on the ILR or can she continue on the Tier 2 dependent visa?
2. I have heard the 'clock gets reset' if she switches to a spouse dependent visa on my prospective ILR. Is my understand correct?
3. In the case that the clock does get reset, what's the best way to proceed for me with the aim that my wife gets her ILR at the earliest possible?

Thanks!

You will have a choice, whether your wife changes to flrm (spouse of settled person) or continue on her pbs dependent and then extend her dependent visa.
if you wish her clock not to reset, continue on pbs dependent. extend her visa to complete 5 years and then apply ilr

Cheers for that!

Also, sorry if this is a stupid Q, but how can my wife extend her Tier 2 Dependent visa once I've switched to ILR myself? Thanks

It is permitted in the rules. She is dependent on YOU not your sponsor.
