SALARY AS PER CODE OF PRACTICE

Post by magelenn » Tue Jul 18, 2017 5:42 pm

Hi everyone, i have my ILR premium appointment next Saturday/22 of July, can i please check with you whether anyone can help me?

The ILR requirements states that the applicant has to be paid £35K to be granted ILR on a 5year route of Tier 2 (General) visa. I have just received all my P60 forms and realised that from 2012-2013 i have been paid £34K, then ive checked the Code of Practice and it says that my job code 3545 Sales Accounts/Business Development Managers experienced role salary is £33K. So is that ok?

This made me worry so much, can anyone please let me know if i still qualify for ILR or should i wait till 2018? I got my Tier 2 visa in August 2012, that's why i am applying on the 22 of July 2017, but if you believe its better to have been paid £35K for alll 5 years, that means i should only apply in July 2018 (however my current visa is until May 2018)....

Please help anyone and thank you so much,
Maggie

That is fine, you dont have to be at £35K throught the 5 years. You should be earning £35K at the time of the ILR. Since you have been at £35K since 2013 you will be fine :)

Thank you so much for your kind help, do you know if i can back it up by printing any regulation to have with me on the day of the interview?

Also, can i please use this opportunity to ask 3 more of my questions:

1/ My previous Tier 2 was refused because my Sponsor put the wrong Code of Practice in the COS form (which had higher salary of £42K) and then i re-applied during Admin Review and was granted a visa, do you think i should write an explanation letter for that to present at my interview?

2/ And because of my above refusal my previous BRP expiry date is few months after my new BRP, is that ok or i can potentially have problems because of this gap?

3/ Is my sponsor letter listing all work related and holiday absences enough as a proof of all leaves? I've collected all boarding passes and event badges/conference badges to proof i was away just in case?

Thanks a million!!!!!

Many thanks for your help,
Maggie

No need, HO know the rules and requirements. An in person premium appointment is not an interview.
