British Overseas Territories & Illegitimate Children/Adults

Post by BOTCampaign » Tue Jul 25, 2017 7:43 pm

Has anyone else had any experiences related to applying and being denied for British Overseas Territories and/or British citizenship by descent, where you are a child and now an adult, being born illegitimately to an unmarried father, who holds both BOTC and British citizenship, and whose parents were also born in the same territory, and you being born overseas e.g. USA, and not in a British Overseas Territory, before 1st July 2006? If so I would be interested in hearing from you. As I understand it, such a category of individuals are still shut out from claiming this right, despite those born under the same circumstances, but whose father's are from mainland UK, had that right given to them through section 65 Immigration Act 2014. It is so grossly unfair the British Nationality Act 1981 still discriminates and does not provide parity, equity & equality under the same law!

Comments appreciated. Thank you for your time.

I can feel your concern about being treated differently, but I am not quite sure I get your argument. The whole point of British Citizen by Decent is that your children are not British, unless they are born in the UK or demonstrate ties to the UK. So comparing your situation to one who's father was born in the UK does not really make sense. Maybe a comparison with a married couple would be more appropriate?

PS: If you describe your situation clearly and in detail, you may get some hints.

I think the point being made is that the UKM/UKF citizenship options only apply to those with a claim to British citizenship. It is not possible to use these facilities to claim British overseas territories citizenship (BOTC) or British Overseas citzenship (BOC). Despite the fact that most BOTCs became (or are entitled to become) British citizens since May 2002.
