I'm new to the forum so excuse me if this has been covered before. I'm trying to get some clarity on the following:
I came to the UK on 21/09/2013 on an ancestry visa and commenced work on 23/09/2013. The visa expires 01/09/2018. I have been told this is not an issue as I can apply 28 days before my qualifying period. I have had some long absences:
I took a 3 month sabbatical from Dec 2015 to March 2016. I have letters from my employer to show this.
In May 2016 I was made redundant. I maintained an address in the UK but traveled around Europe, India and Australia with my British fiancee until Feb 2017. I was back in the UK, not working for several periods during this time. At my intended date of application (25/08/2018), I will not have exceeded 180 days absence in any of the 12 month periods.
In Feb 2017, I began looking for work. In March 2017 I started a business and began work as a contractor.
My question is, even though I meet the <180 day per year requirement. Will these other absences count against me in an IDR application as the travel is not part of the original intention of the visa? If so or if there is a reasonable chance of it doing so, I will probably look to apply for further leave to remain via ancestry as it looks simpler than going the spousal route.
Any thoughts or experiences you have would be greatly appreciated.
