AR refusal NEED HELP

Post by kusuz » Fri Aug 04, 2017 7:18 pm

Hi,

I applied for AR which was refused today and point is as below:

Being small business we have not registered under PAYE. This link was sent by my accountant.
https://www.gov.uk/paye-for-employers
and this has become my one of refusal point.

now if we go for fresh application how am I going to sort this out? as my company is now more then 4 years old.

Now do I have only 2 ways?
1) Fresh application
2) Judicial Review

I have only 1.6 years for my 10 years in UK. Would this both count under that if I am going for any 1 option?
Or which other option I have for keeping 10 years of records.

Many thanks

You should have continued in your earlier thread.
According to your earlier post, the reason for rejection was the investment and you had got points for employment.
What changed now ?
Did UKVI quote a specific clause of the immigration rules ?
Being a small business does not give you exemption from registering from PAYE. You are only exempted if all your employees are paid less that GBP 113 per week - how did you manage that - all apprentices or all PT workers ?
You could still have registered for PAYE - were you not aware of the requirement ?
What documents did you provide for employment/job creation evidence ?
My comments are in no way meant to be advisory. I have no professional knowledge of immigration. These are based on my own experience, convictions and personal interpretation of publicly available information.

I didn't know one could thread the previous conversation.
Yes my earlier post was for investment where my accountant didn't mentioned my name in annual report. He made new report before we submitted our admin review but they have not considered new documents.
And for employment they have raised this issue.
I have joined existing company. they have always used PT staffs because of nature of business and they have never registered for PAYE even till now. Accountant said It is not needed.
