Tier 2 Application time

Dear all,

waiting for the decision on Admin Review right now. I'm wondering if AR still holds the original decision. Does it mean from the moment i get the decision, i become a overstayer? do i have 14 days to submit a new application? can i make a tier 2 application within 14 days of receiving the decision or i have to get a result within 14 days (use priority service) to avoid overstaying in the UK?

Yes, you become an overstayer.

Yes you must submit an application within 14 days of AR refusal.

Thank you for your reply CR001.

in that case, i submit a t2 application in 14 days, do i have to be granted within 14 days or i can wait for the application decision as i found that 3c or 3d doesn't apply when it is an out of time application.

There is no rule that it must be granted within 14 days. You can wait for the outcome but you will not be permitted to work.

You must already be in the UK under any of the following visas or schemes:

Tier 1 visa
Tier 2 (Sportsperson) visa
Tier 2 (Minister of religion) visa
Tier 2 (Intra company Transfer) visa under the Immigration Rules in place before 6 April 2010 and you’re applying to change sponsor
Tier 4 visa - if you have an eligible qualification or you’ve done at least 12 months of a PhD"

if AR is unsuccessful, i would become an overstayer. im wondering if i can apply for switching to Tier 2 in the UK as I was on the T1GE.

Unless you post your full UK Immigration history and reason for most recent refusal, no one can give you any useful advice.

You have posted in the Tier 2 General sub forum, so any member reading your post would assume you applied for Tier 2 which was refused.
