Spouse Visa for Over Stayer

Post by Thunder12 » Mon Aug 07, 2017 6:47 pm

Please can someone help?

I'm sick with worry. I am a UK citizen married to a Thai national. I want to bring my wife to the UK on a Spouse Visa - however; she previously overstayed a student visa whilst in the UK for a period of one year.

She was held in a removal centre and sent back to Thailand at the UK government's expense.

Does this constitute an Enforced Removal and if so will this mean an outright ban on her returning to the UK for 10 years??

She told the authorities she was happy to go back to Thailand and wanted to pay for her flight, but as she had been initially held in a police station, they had failed to forward her phone which contained all her family's phone numbers In Thailand. It was only returned to her after the flight had been paid for. She was told she could not pay for the flight after the fact.
