Traveling After Being Dismissed on a Tier 2 Visa!

Hi,

I am a USA citizen and came here on the 1st of April, 2013 on a Tier 2 (General) visa sponsored by my company. I have been dismissed from my job on the 8th of May, 2017 and have not had any luck finding a new sponsor. I have yet to receive the curtailment letter and understand that it can take anywhere between six to eight months to receive it as the Home Office is quite slow with this. My actual visa does not expire until April 2019.

Please help me to clarify the following issues.

1. I had previous trips booked one to see my family in NY and another holiday to Croatia. Besides the point, will I be able to get back into the UK once they ask me if I still work for the X company and say no? I have a flat, a cat, and a life here still. Could they detain me at immigration?

2. I have been applying to jobs only to companies listed as licensed sponsors already by checking this link https://www.gov.uk/government/uploads/s ... onsors.pdf. However, have had no luck. Does anyone have any recommendations on what to say about if I require sponsorship?

3. How long does the process of switching visas take approximately to a new sponsor?

4. Does the 5 year period for indefinite leave to remain expire after being unemployed over 60 days?

If anyone could please shed some clarity on some of these issues, especially 1 and 4 I would really appreciate it. Thank you very much in advance.

Risky (click) and yes, you can be refused entry.

You need to say 'Yes' as you require sponsorship unless there is any other visa you qualify for.
3. How long does the process of switching visas take approximately to a new sponsor?
RLMT has to be done, so minimum 28 days for that before they can issue you with a CoS. You can then apply for a visa using the premium same day service.
4. Does the 5 year period for indefinite leave to remain expire after being unemployed over 60 days?
If you have more than 60 days between the last day of employment and the new Tier 2 visa application, ILR is likely to be refused.

How have you been maintaining yourself since you have not been working?

That is a good question. Quit smoking, no traveling, Airbnb, savings, etc. I can pull another couple of months but debating if it's worth it if the I lost the four+ years due to the unemployment gap. It's either keep trying to find a sponsor, find a marriage partner, or move to Miami. Very frustrating, plus have trips booked in September and nieces sweet 16! :(

I just can't imagine how they wouldn't let me back in to sort my things? In that case they can contact my agency and tell them that I won't be paying rent due to no entry to the country?

My visa is still valid, and the home office has not told me to leave yet. I just can't imagine why they wouldn't let me back in with all my stuff still here!!

Update:

Home Office confirmed that as long as your visa has not been curtailed you are able to travel. In order to find out if your visa has been curtailed, you need to write to the following address and wait a couple of weeks for a response. I really hope that by writing to them I don't speed up the process of curtailment.

You should be aware that your previous employer would have informed HO within 10 days of your employment ending that you are no longer working there or being sponsored by them. This will be noted on the system.

Curtailment letters simply take time to get sent out

The HO call centre is well known for giving out incorrect information and take no responsibility for it.

Another question,

What if the company has been already advertising for more then two weeks on more than one platform? Is that taken into consideration for the RMLT?
