Questions regarding FLR(M)

Post by InAPickle » Wed Aug 09, 2017 8:10 am

Hello, I am wondering if some nice people here could provide some advice with regards to my wife's spouse visa application and clear up any confusion I may have.

We are both currently working in the UK however we only started working last month so we must apply through Cat B. We do have the savings if needed, however we'd need to wait longer for that to become valid (held for 6months).

I've been with a few different companies during the last year (my final year of University) and as has she, so the breakdown for the 12month period is as follows:

April:
- £3000 signing bonus for me from Company A

July:
- £2400 income for me from Company B
- £2400 income for me from Company A
- £3000 income for her from Company C

August (end of month)
- £3250 income for me from Company A
- £6000 relocation bonus for me from Company A
- £3000 salary for her from Company C

Both of our salaries are more than the requirement so part 1 of category B is satisfied. With regards to part 2, the breakdown above meets the requirement.

However I'm slightly confused as to whether I can include my relocation and signing bonus in the addition, there's other income I could include such as her pension lump sum and some earlier income I obtained but they're harder to get the requirement documentation for.

I am also correct in that for each income, I require the original payslip and a letter from the company?

If anyone could clear up my confusion it would be greatly appreciated. And sorry for any grammatical mistakes, I'm posting this on my phone.

Thanks.

You require at least 6 months payslips with 6 months corresponding bank statements.

But I am applying through Cat B. I don't have 6 concurrent month payslips as I've not been employed for 6 months.

The requirements are, regardless of Cat A,B etc, to provide a minimum of 6 months payslips and 6 months corresponding bank statements. Often you need 12 months of each depending on circumstances and appleis even if you work for 3 employers for only 2 months.

Submitting less than 6 months is likely to result in a refusal.

How is it possible to provide 6 months of payslips if I've only been consistently working for 1 month. That sounds like a ridiculously stupid requirement for cat b.

It is a standard requirement for a spouse visa. If you don't have 6 months payslips or evidence of substantial savings of £62,500 held for at least 6 months, you won't be successful with a spouse visa.

If you don't have 6 months evidence, you will need to wait till you do before applying.

When does your partners visa expire?

How long have you been married?

How long has your partner been in the UK?

Any children?

Her visa expires in October, we have the savings required but we would rather not wait for that to become valid because she would like to apply to some Universities before then. She has been in the UK for 4years.

I don't see any information relating to the requirement of 6 months payslips when applying via cat B.

"2. In respect of salaried employment in the UK (except where paragraph 9 applies), all of the following evidence must be provided:
(a) Payslips covering:
(i) a period of 6 months prior to the date of application if the person has been employed by their current employer for at least 6 months (and where paragraph 13(b) of this Appendix does not apply); or
(ii) any period of salaried employment in the period of 12 months prior to the date of application if the person has been employed by their current employer for less than 6 months (or at least 6 months but the person does not rely on paragraph 13(a) of this Appendix), or in the financial year(s) relied upon by a self-employed person."

I have payslips covering Oct 2016 - Feb 2017 and July 2017 - Aug 2017
