I have quite a complex situation and maybe I can find any guidance of what is the way to go here. First, out situation.
Me: EU-citizen
Spouse: non-EEA-citizen but has residence in EU-country expiring in 4 years time
No children
Married for 2.5 years, if this helps
I have been offered work in the UK with paid accommodation and travel costs, but everything is paid by my EU-company outside the UK. They rent the apartment and provide it for me, they file the taxes in the UK for me, so that I do not need to take care about my legal situation.
Because I have limited to the health service (I am not resident in the UK), I need to pay my medical expenses, which are paid by my company.
But this generates a problem: if I am not working with a contract signed in the UK, how can I sponsor my spouse?
Here comes the problem: my spouse wants to come to London with me sometimes, I do not like the idea of being separated for a long time. I want her to come, but not to live in the UK, since she works and will work in the other EU-country. She wants to stay with me on the weekend, or for one week. Regular visits.
So we ask now for a EEA Family Permit, she can come and go out of the UK for 6 months. This is great because the EEA FP is free to apply for. But after 6 months is when I do not know what to do. She has no intention to change the residence. She just wants to come sometimes to me.
My ideas are:
* Can she apply for another EEA Family Permit after 6 months (apply outside the UK, of course)?
* Does it make sense to apply for UK residence just so she can come to the UK but really do not live in the UK?
* Or should we be looking at a Standard Visitor Visa after the 6 months of EEA Family Permit?
* The option 4, less desirable, is to fly together after the 6 months (very risky, since there are immigration controls before flying to the UK) and request a code 1A stamp on her passport on arrival.
We are 98% sure that we do not want to live in the UK after my contract finishes. It is just not the place we imagine to live in. Therefore I do not care if she obtains residence or not, we will leave the UK and never look back.
