One day premium service Croydon - further enquiries

Hi all,

We have applied for spouse visa extension at premium service in Croydon, booking/payments were made on the 16/07/2017 there was not any availability till 01/08/2017 and my wife's visa expired on 28/07/2017.

We got a letter from them after 3 hours of waiting saying that the "application is valid but there are further enquirers that need to be made" and this is because we didn't apply while her visa was valid, even if there wasn't any appointment available between 16th of July and 1st of August 2017.
Apparently they can not refuse her visa because we have British born child...!

We have been told that someone will call but they didn't give as any time-frame, we have been waiting for that call for over two weeks now and we paid £590 for "premium service" plus £75 additional charge because there wasn't availability on working hours (our appointment was at 6pm).

I would like to hear from anyone who has knowledge or went through similar experience, approximately what's the waiting time and what can happen next?

You applied after her leave expired. You should have posted it or gone to a different PSC. The application may be valid but that does not mean it will be approved...

I am not sure what the current status is on overlooking short overstays...

Yes, if i have posted, visa would have still been valid, probably by now we should have had the answer.
I thought they would take under consideration that the booking/payments were made two weeks before the expiration date.
I just hope that we get a positive answer whenever we receive that 'phone call'

I submitted FLR M on 8 weeks ago at PSC , still no answer !! they only gave a letter that application valid and further enquires ...............

Anyone have any idea how long it gona take ????? :cry:

Nothing yet, application status: Awaiting a decision, it's been almost 10 weeks now.

Have you heard anything, what's the submission date?

Hiya. As per my knowledge they would overlook a period of 28 days after visa has expired so that shouldn't hinder them. I am hoping and also sure that there's nothing to worry about as far as visa expiry is concerned.
Home office are just slow.

For ILR yes, not for a spouse visa exension. Set(M) does not necessarily require extant leave. FLR(M) however does and applicants should always apply before their visas expires otherwise they risk refusal.

Hi,

Quick update.

They called us yesterday (17/10/17) on 12th week, we got the visa but for 3 days overstay they put my wife on 10 years route, which means she has to apply for FLR next 2 x 30 months than apply for ILR.

No, that is HO following the rules for an applicant that applied after their visa expired. HO could have refused the application and issued removal instructions but granted FLR(FP) Partner route instead.
