Job Creation Query for Extension

Job Creation Query for Extension

Dear All,

I need your help regading one of my query. I am due to apply for my Tier 1 Ent extension end of this month and i have a query regarding the job creation.

I come under the Post April 2014 category with regards to job creation.

I have one current employee who has completed 12 full months so no problem for him. ( Aug 16 - Present)

I am just confused about my second job creation.

I had one employee (EMPLOYEE 1), which i employed a couple of months later i got the visa but the problem was that she left after 10 months. ( Oct 14 - July 15)... Once she left, i didn't have any employee for the next 3 months. I then hired another employee (EMPLOYEE 2)for 12 months (Nov 15 - Oct 16) but the problem was she only worked (90 hours per month) for the first 9 months..She only worked (130 hours per month) in her last 3 months of employement. So i am not sure if i can combine these 2 employees to claim one job creation as UKVI might argue that Employee 2 was part time for most of her employment.

I have one other current employee (EMPLOYEE 3) who started her employment in May 17. ( May 17 - present) She is full time and works 138 hours per month.

I was just wondering whether i can combine employee (1 & 2) or (1 & 3) to create one job creation. I was thinking of combining 1 & 3 but i asked one of the solicitor and he said the gap in between is too big.

Would really appreciate if somebody can help.

I assume you mean "after i got the visa".

You can combine Employee 1 FT for 10 months with Employee 2 FT for 3 months, which is more than the required 12 months.
In the job table, only include the 12 months you need and only provide documentation for those 12 months (1 additional FPS may be needed for Employee 2 to show start date)

You can do either combination. The immigration rules do not limit the time of the gap.

I am planning to submit all my 3 years FPS.

One other question i have in mind is that in the 'Accountant's Job Creation Letter' , do we have to mention all the employees of the companies or just the employees we are claiming the points for job creation?

Why do you need a 'Accountant's Job Creation Letter' ?

I thought it was one of the requirements.

Accountant’s letter verifying that the new posts have been created
199. If you took over or joined an existing business, you must also provide an original letter from an accountant, to verify the job creation. The accountant must not be you (if you are working in your business as an accountant), must have a valid licence to practise or practising certificate and must be a member of one of the following professional bodies:


Not sure if this applies to me as i formed my company in June 2014 and then i applied for my visa in Aug 2014.

No, it does not apply to you.

Your business is considered a "new business" as it was set up not earlier than 12 months of your application date.

Do i need to provide the documents(passport copy & contract) of all my employees( 6 in total) during my 3 years or just the employees ( 3 employees) that i am claiming job creation for?

Same question when filling out the online application form. Do i mention all the jobs that were created or just the 2 jobs that i am claiming the points for?

You only need passport copy. Contracts are not necessary.
You only meed to provide information for the jobs you are claiming for the points - not all the jobs/employees.
