Tier 2 G ILR / 10 year Route

Post by nbandla » Wed Aug 23, 2017 2:48 pm

Hello

I came to UK on 19 Sep 2010

Got PSW after masters until 19 Aug 2014.

Changed to Tier 2 on 19 May 2014 for 5 years visa until 18 Aug 2019.

If i dont get 35k by the time i qualify for ILR, i believe i can extend Tier 2 for one year untill 19 may 2020.

Questions
  • 1) To qualify for 10 year route what is best chance to kill this months GAP from 19 May 2020 till 18 Sep 2020 ?

    2) I have PSW until Aug 2014 but i changed to Tier 2 G on May 2014, but VISA was given until Aug 19? so can i consider Tier 2 G extension until Aug 2020?

    3) Is the Tier 2 G 5 year ILR 36K, for overall year, or if get increment on last 3 months showing on payslip as annual salary 36K, will this be enough or should actually earn in last year before i apply ILR?
Thanks
Gop

You would need to find a visa that you qualify for (Tier 4, PBS Dependent if applicable, Tier 1 Ent, etc).
2) I have PSW until Aug 2014 but i changed to Tier 2 G on May 2014, but VISA was given until Aug 19? so can i consider Tier 2 G extension until Aug 2020?
If your Tier 2 G was valid from May 2014, then you cannot hold a Tier 2 G visa any longer than May 2020. It is the date visa is granted that counts not the date you applied.
3) Is the Tier 2 G 5 year ILR 36K, for overall year, or if get increment on last 3 months showing on payslip as annual salary 36K, will this be enough or should actually earn in last year before i apply ILR?
You need to meet the requirement at the time of ILR based on Tier 2 G 5 years residence. Even one month payslip will be sufficient. However, sudden large increases raise a red flag instantly with HO as they are very aware of migrants getting a one month increase only to meet the ILR criteria. You don't state what your current salary is so no one can comment on whether an increase will look suspicious.

Regarding salary change: if my current employer pays 30k, and i change my employer in Sept 2018 who pays 36k or more and apply for ILR in 2019 May will be acceptable i think ? Someone told i have to earn 35k in last year and paid tax for 36K?

Your gross salary must be at the level stipulated by HO for the relevant year you apply. Don't listen to 'someone'.
Salary Threshold Date new threshold commences
£35,000 6th April 2016
£35,500 6th April 2018
£35,800 6th April 2019
£36,200 6th April 2020
