Dear Forum Members,

Hope you all are doing well.

I am a British Citizen and my wife is on Tier-1 Dependent route. She is due to extend her visa in December 2017 to cover a gap period of almost 4 months before she can reapply for an ILR.

I easily make up for the Financial requirement as I am earning over £70K per year. I have just heard from someone that one needs to be with one employer for a minimum of 6 months before making a spouse application.

I have got a new job offer which I am probably going to start in Nov 2017 (after serving my notice period with the current employer). Issue is I will have been in my new employment for just 1 month then.

Can I apply for my spouse extension couple of months early - for e.g. next month in Sept while her visa is valid till Dec - so I don't have to worry about being with one employer for 6 months before making an application.

What you have 'heard' is NOT relevant to Tier 1 General dependents. It is ONLY relevant to FLR(M) spouse settlement visa applications, which is not the visa your wife holds based on your post.

- Can I still apply early? As she only needs to cover 4 months extra from Dec onwards to qualify for ILR.

- Also one more thing - How much do I have to pay in IHS fees? I am confused - as this will be her 3rd extension to cover up for an insane Gap of a few months - don't know why they couldn't give her a longer visa when I already had an ILR to cover up for this. Probably to get more fees out of us. Will the IHS fees need to be for 2 years or 3 years?

Yes you can apply early. Make sure you have the 90 days maintenance funds in order.

The visa extension will be for 3 years, IHS payable for 3 years. As you are newly registered and you have not posted YOUR immigration history and relevant visa dates or your spouses visa date details or date she originally entered the UK, I can't comment on the shortfall she has.
