This came as a complete shocker.
My husband is an EEA citizen who got a settlement card. I'n from Outside the EU.
Based on that, we applied for IRL (yes, this was a mistake, we got confused as the HM website said that for a settled person spouse you have to apply for IRL) we should have followed the EEA route.
We lost a lot of money applying for the wrong visa, but decided to stay hopeful as technically that route was not completely incorrect either.
My previous spouse visa expired last february, whilst the IRL was being processed.
Now came the shocker. After eight months of agonizing wait, then requesting my docs back ( with the remark that of there was any chance to finalize the visa within 10 days please do so) and several follow ups, the application came as refused and with the order of leaving the country in 14 days.
My passport was not returned, just the other docs.
This means, i can't even apply now for the EEA route, as there is no passport to submit ( i assume they want to make sure i leave and give it back ay the airport?)
We fulfilled all requirements, my husband is a company director and all requirements were dully fulfillled. The reason given for the refusal was "we see no reason why you and your family can't settle in another country"
Has anyone experienced something like this? I don't mind applying now for EEA permanent residence, but need my passport back of course to do that.
