Urgent Help wanted Salary drop After Visa Tier 2

Post by Micheal911 » Sat Aug 26, 2017 8:55 am

I am currently changing an employee from one NHS trust to an another. However, I have my new visa at hand and submitted it to my employer. The strangest thing happened when they received it. They offered me a salary of 6,000 pounds lower than what was promised all along.

They claim their HR person made a mistake by offering me 39,000 pounds and they believe a fair wage is 33,000 pounds. I am totally confused at the moment as my COS says 39,000 pounds which they issued for the visa. I am one year 2 month away from ILR.

If they issue me a new offer. Does that mean I will need to reapply for a new visa? Or can this be covered under change of circumstances. I have called UKVI help line and the customer care was a little confused. He said I should just reapply again or get the employer to call. Given they have made a mistake once I don't just want to leave it up to them.

If its 39K mentioned in COS then it has to be same. They cannot just drop 6K. They might end up getting licensed revoked. This is against RLMT.

You speak to HR and make sure you are being paid same otherwise you will not be able to get ILR next year

Reductions in salary
26.21 If you decide to cut a migrant’s salary package to a lower rate than you stated on their CoS, such as, if the allowances offered have changed, the new rate that you pay to them must meet the current appropriate rate requirements.
26.22 If the new rate is below the appropriate rate, you cannot continue to sponsor them and you must report this to us using your sponsor management system (SMS) account.
