SET (O) Form Query

Hi All,

I am currently on Tier-1 Entrepreneur visa, Extension granted few months ago.

I was preparing for ILR on 5 Years route. I have following question regarding SET (O) Form.

I will be applying for ILR along with my dependant spouse. We both granted Tier-1 same date so we both will apply for ILR same date.

After looking into SET(O) form, I am confused that do I need to fill two separate SET(O) forms for Main Applicant and Dependent or just 1 form is enough for both applicants???

Because if you look at SET(O) form, like fees section, passport section and criminal conviction section, they have asked for both you and your dependent together. Therefore, I thought we might need to fill one application form.

Please let me know if anyone know about it. Thanks.

just 1 form is enough for both applicants???
This one, assuming your wife is a PBS Dependent visa holder.

Yes, she is Tier-1 dependent. we switch to tier-1 ent from UK. we both granted initial visa same date.

I have another question regarding ILR. We will apply for ILR on Set(O) form on 5 Year route.

During our application, I will also quality for 10 Year route Set (LR).

If for any reason they refuse our ILR on 5 Year route, and we go for Admin review after that.

1. Can I apply for 10 Year Set(LR) during pending Admin review?

2. Can I apply for 10 Year Set(LR) after rejection of Admin review?

Please make note that in this case, my 10 years already been completed.

Your response will be highly appreciated.

No need to bump your post. It is a bank holiday weekend when people spend time out with friends and families.

Does your spouse also have 10 years long residence?

In that case, my spouse will apply FLR(M) if i go for SET(LR) route.

Correct and you/she needs to meet all the requirements (English SELT and financial requirement). This will reset her clock to zero and a new 5 year route to ILR (2 x 2.5 year visas) based on 5 years residence (or 10 years long residence if she reaches that first).

If your ILR LR fails, her FLR(M) will also fail.
