EEA extended family member validity

Hi,

I have a non EEA brother who currently lives in the UK but has no leave to remain left. My wife is an EEA national but we only married after me and my brother were living in UK so he wasn't dependent when he moved here so his EEA(EFM) was refused. He has been dependent on us for a while now and lives with us due to no leave and he has an application pending which I assume will be refused.

My question is, If he goes back, how long does he have to wait so UK will think he is wishing to join us here and is dependent on us?
