English B1 test question

I think it says that you should apply Set(M)

I know that Set(M) is for ILR and I'm confused about this. Someone replied

"SET(M) doesn't require extant leave therefore it doesn't matter if spouse leave has expired! Apply for SET(M) and get the B1 English and LIUK completed."

Your wife doesn't qualify for ILR as she hasn't completed the full 5 year period of residence as a spouse, which is mandatory for a SET(M) application.
(Casa, not CR001)

Sorry about all these questions. I'm just really paranoid and stressing out at the moment.

I forgot to mention that she passed her Life in Uk test and English B1 test at the end of Last year.

How likely will they grant her an extension rather than a Refusal when we go to our Premium appointment? I will list the Pros and Cons

Cons:

1. She has overstayed for over a month

Pros:

1. We have so many documents that I have listed above in me, my wife and joint names and including our kids
2. My wife gave birth on 1st of June by ceaserean and she wasn't fit and well. She needed a lot of rest (we have hospital letters to prove she had this surgery and its one of the reasons we didn't extend in time)
3. I have a disability and its our only source of income and that's another reason we didn't extend in time. It took me over a year to save up for this and it kind of drew things back when I had to buy things for my newborn
4. She got a perfect score on her B1 English speaking and listening test and that proves she has an excellent understanding in English. I have a disability and I don't really speak clearly and I kind of have a stutter and a speach impediment and I have grammar issues and that proves if she understands me, then she doesn't have a problem understanding everyone else.
5. We have 2 kids and one was born last June.
6. She is married to a British citizen and we have a Marriage certificate to prove this

What are our chances of succeeding once we turn up to our premium appointment?

Would it help if she got a letter from her doctor to say how she was after her surgery and she wasn't in a good state? She had to have a blood transfusion

I forgot to mention that she was meant to give Birth on 31st May, but it was postponed to 1st June because she had to have an emergency blood transfusion because her blood levels were too Low. She had to have 2 bags of blood and she had to have another bag of blood after her surgery.

I just found out that the rules changed last May and anybody who needs to extend their visa (FLR) needs to pass the A2 test.

Is my wife's B1 certificate fine?

B1 is sufficient.

Here is an update regarding my wife's visa extension

I didn't take any of your advise because it was wrong

My wife's visa got granted a further extension for another 2.5 years and she got this because we hired a solicitor who applied under the (FLRM) application and we were advised at the beginning to cancel our premium service appointment because that would have been a straight refusal

You advised me to apply under the (FLR FP) and she will be on a 10 year route and you also advised me to go to my premium appointment

I'm not saying you don't know anything about immigration, but you obviously don't know anything about what to do when you overstay. Probably you are right, when you overstay and you don't have kids

I am also in the condition as you were before... googling around i found your post and was fascinating to find your success.

Could you please let me know how long did it take this whole process.

What visa did you get. 5year toure or 10 years route.

Regarding my case i was late to extend my flr m by 3 days.. i applied back on 10 th of August 2017.. its exactly been 3 months today.
Have already done biometric 6 weeks back but haven't heard anything yet.

Will appreciate if you can throw some light on it.

It took about 2-3 weeks after the FLRM application and documents were sent off before we received a letter asking for my wife's biometric Information. We sent her Biometric info off about 2 days after we got the letter and then it took about another 2 months before we got the results from my wife's visa extension

My wife got granted a visa extension that will expire on May 2020 and then we need to apply for the Indefinite Leave to Remain.

My wife gave birth the month we were supposed to extend the visa, so the Home office took the Pregnancy/birth into consideration and I gathered loads and loads of documents. I kept all the hospital letters and I contacted places like npower, talktalk, utility waters etc. and I asked them to send me monthly statements from the beginning of my contract until now.

I suggest hiring a solicitor. You will be refused if you try to fix this yourself. You need Legal help

I firstly went to citizens advise and then they recommended a local solicitor that is very professional with a high success rate
