10 year long residency, while SETO is on pending

Post by Pooj » Wed Sep 13, 2017 9:17 pm

Hi,
I am wondering whether anyone had the same experience on this

I have applied SETO last year with my wife and the first application got rejected(tax issue) and then we reapplied before the visa expired in the same category, now we are still waiting for the results(had interview)
In the mean time, I am completing 10 years long residency in UK this month and I wanted to apply for this so it will give appeal rights
But the problem is my wife has not completed 10 years and I wanted to know how do we apply for her as my last visa expiry is Feb2016 and if I choose to apply for 10 year long residency, mine and wife's SETO will be automatically withdrawn, if we both send the applications together, what will be the application for her
and will that still be allowing her to be a continued resident or will they say that she will have to go back to the country and apply again?
It would be really helpful if anyone had the similar issues or any of you know anything about this?

Thank you
Pooj

When you apply under SET(LR), technically all of your ILR ineligible PBS dependants should switch to FLR(M).
So you can vary yours to SET(LR) and hers to FLR(M)
