Can I apply under category B as a freelancer?

Post by firecatcher » Sun Sep 17, 2017 3:50 pm

Hello everyone. This is my first post on this forum and I would appreciate your thoughts on my situation.

I am a British citizen currently living in Tokyo and would like to return to the UK with my wife, who is Japanese, to settle. We are currently putting together an application, and I have some questions about the financial requirement.

This is my background:

I have been working for a translation company in Tokyo since May 2016. Although I am technically freelance and file my own taxes at the end of the year, the company is my sole source of income and I receive a monthly salary from them which varies according to how much work I choose to take on. Over the last 12 months I earned well over the income threshold. The company has told me that they are happy to keep sending me work me after I return to the UK, and will pay me in sterling via their UK entity. They are also happy to provide me with a letter guaranteeing me a certain amount of work going forward (which will reflect an income that is higher than the threshold).

Can I apply under category B (non-salaried income)? I have payslips and bank statements that correspond to all the compensation I have received over the last 12 months, which prove that I have exceeded the income threshold, and I also have a letter from my employer guaranteeing me a similar amount of work going forward.

I thought, however, that I may have to apply under category F because I am technically self-employed. Under category F, I am required to submit a tax return for the last full financial year. However, as the tax year in Japan runs from Jan-Dec, and I began working freelance in May 2016, I wouldn't be able to provide proof of income and a tax return for my first "full financial year" until January next year, and only then would we be able to start the visa application process.

Please clarify whether I would be able to apply under category B, and whether my understanding of category F is correct.

Many thanks,

Jamie
