Hello,

So, my friend applied from tier 2 dependant ICT to Teir 2 general which got refused because he did not submitted English test certificate because according to latest immigration rules u just need to write the English certificate reference number.

He claims that in his refusal letter it was written that due to non submission of English certificate.

He applied for the appeal.

Now he says he has lost the appeal . Vfs says that it’s our mistake and it was fine even if he do not submit English certificate and they should have checked it online.

But they rejected his appeal and now says that he might be preselected .

Can they write another refusal reason in appeal?

I am worried I have to apply for my wife visa as main applicant.

Her company has done proper RMLt and interviews are going on with other candidates as well.

What if vfs does not believe her proper RMLt ? How can her company make sure that proper RLMT has been done? The job add was given on two websites for 28 days. And lots of people had applied.

Hello,

Can anyone please help me and explain how to make sure that proper RLMT has been done?

My wife’s company has posted job add on two websites - universal jobmatch and monster for 28 days.

Many candidates applied and now interviews are going on. Her skills are good and better than the others as her company is ready to sponsor her where she is already working .

Is this fine? Salary will £30,000 .

Can her visa refused? How to make sure that proper RLMT has been done and she is not pre selected.

Hi

I had applied for Teir 2 main applicant but my application got rejected.

Refusal reasons are :-
1.Proper RLMT not done

2. If I work for the same company for more than 18 months then i can't apply for their 2 within the same company

3. Job title is same as the one which I am currently doing

4. Job was created for me only

(My answers - proper RLMT was done, job add was given on two websites, never heard about 18 months rule, job titles were different, job was created for everyone and lots of candidates had applied and interviews were taken.)

What can I do ? Please help

What is your SoC and Job Title?

Why was no one else successful with applying for the job?

How long have you been in the UK previously and what is your UK immigration history?

1. Soc - 2139, systems TESTER

2. Other candidates did not have enough skills. My skills and experience is more.

3. Fours years in uk as teir 2 dependant.

It would be beneficial to members offering free advice to keep all your questions in that topic then to avoid repeat questions being asked which likely has already been answered.

HO clearly believe you have been pre-selected, which does appear to be the case. Your 'friend' was warned about this if you read the entire thread.

Settled (ILR)/BC/EU applicants, need to closely match the requirements. If they have some skills and can do the job, it should be offered to them.

I work as a Test consultant currently.
The job I applied was "systems tester".

My ILR is due next year but due to some reason I wanted to become the main applicant.

If I don't appeal or don't reapply and stays on my current visa then can it affect my ILR next year?

Testing people are ten a penny, RMLT does seem compromised.

You clearly have not been given the advice that we provided to your 'friend'. You cannot apply for ILR next year based on 5 years residence if you change to Tier 2 main visa holder. Your clock resets to zero and a new 5 year residence period before you qualify for ILR.
If I don't appeal or don't reapply and stays on my current visa then can it affect my ILR next year?
PBS route visas do not have appeal rights. ILR as a PBS dependent should be be affected by this refusal. Assuming of course you qualify for ILR and your partner meets the requirements for ILR as the main PBS visa holder.

1) Yes, I know my clock will reset to zero.

2) in what way my ILR will be affected? (If I stays on my current visa teir 2 dependant and apply for ILR next year.)
