Confusing acknowledgement letter

Post by jwriter » Tue Sep 26, 2017 4:07 pm

Today, I received my biometrics letter for my FLR(M) application. An acknowledgement letter was in the envelope as well, but I'm confused (and very concerned) by the wording of some of it.

It started out as, "Thank you for your application to stay in the UK. We will decide your application within eight weeks from the date you submitted it unless we are prevented from doing so for reasons beyond our control." And then they list various reasons why there might be delays.

Then, it says,

"We will notify you by letter if we are not able to decide your application within eight weeks from the date you submitted it and will advise you of the new timeframe for deciding your application.

Your application raises issues relating to the European Convention on Human Rights which are complex in nature. As such, it falls outside our normal service standards for deciding leave to remain applications. Please be assured that we will make a decision on your case as quickly as possible.

You have requested leave to remain outside the Immigration Rules which are complex in nature. As such, it falls outside our normal service standards for deciding leave to remain applications. Please be assured that we will make a decision on your case as quickly as possible."

Needless to say, that doesn't sound good, and I'm confused about what this means. Until now I thought our application was pretty straightforward. We meet the financial requirements, we live together, and we got married in August. I'm switching from a Tier 4 DES, and the application was posted and received by the Home Office before the expiration date. Very stressed over here.

It is a standard letter, many applicants get it. Simply means your application might take longer than published timeframes.

Hi jwriter,

I got a similar letter.

Do you have any updates please on your situation? Likewise I'm really concerned as well.

Would really appreciate if you have anything to share.

Thanks in advance.
