Adoption - nephew from India

Hi All,

Looking for advise about adopting my nephew from India to UK.

I live in London with my wife and son since 2008. I have two elder sisters. One lives in Australia – is married and has a son. My eldest sister live in India. She got married in 2000. She had a son in 2001. She then happened to get divorced in 2004 and then married her second husband in 2009. She is not having any child from second husband. During her first marriage, she developed physical challenges due to difficulties and issues of tension in the marriage. My nephew was born prematurely. He was doing quite well though until my sister got married second time. However, my nephew is not happy after the second marriage and has remained quite sick since then. He is quite distressed.

For the best interest of family, my wife and I would like to adopt him and bring him to UK to live and grow with us. My nephew is very close to us, especially since he was living with us while I was in India. Nephew is seeking for help and we would like to give him love and care he deserves. My and my wife are both working full time, so we do not have any financial issues.

Please can you provide your initial thoughts about this matter? Also what will the process?

You face a number of obstacles.

1. The child is 16 years old and has lived in the current household with the new husband for 13 years. So why now to adopt when he is almost an adult??

2. As you are a UK resident, you have to follow the UK adoption processes. See adopting-a-child-from-overseas (click(.

3. HO view these types of 'family' adoptions poorly and getting a visa is going to be challenging. See see Point 18. SET7.18 (click)

Out of interest, did you previously (in 2011) succeed in bringing your father and sort out bringing your aunty??
