When to apply for ILR 5yr route!

Hiya

My hubby was issued his spouse visa on the 5th Dec 2012 however they took time to give it to him so he never actully entered until the 9th of Jan 2013.

Understand you can apply so many days before but can't work out when this would be is it from visa issue date or entry date? Can anyone advise earliest date please?

Also he complete his life in uk over 2 yrs ago as they issued him on the old 2yr route in error which was sorted at in person apt - is it still valid?

Is the trinity GSCE the best english test? His english is perfect so just looking for quickest option!

The 5 years residence is counted from the date of entry to the UK.

He can apply no sooner than within 28 days before 9th January 2018.

LIUK does not expire.

English test must be from an HO approved test provider on the HO list, level B1 required for ILR.

Perfect thanks gives me a little more breathing space as he's self employed so pain for docs although I make enough as well but like to provide both sets of docs!

Hiya

It advises to provide 1 or 2 years worth of sa302 documents

If hubby has made plenty in the last year would you still provide 2 yrs worth?

Also advises that bank statements for same period must be supplied. Does this means from april to april - we apply in dec so would we also need to supply from April this year till nov of bank statements?

Is there a good guide on the exact documents needed - we do everything ourselves so don’t have an accountant

As you are self-employed always better to provide more than 1 year if possible, and depending on when you are going to apply, SA302 I think is from April to April (financial tax year) so you might need to provide last year's plus up until just before you apply. Same with the bank statement hope this helps.

Some further questions

1. My husband is under the construction industry scheme and we do all out tax and vat ourselves so no accountant.

What documents will he need to supply? having looked at fm-se it advises 12 months for tax year if made enough which he has! I saw a small bit in there about cis scheme but just want to make sure we have the right documents. Also if tax year ends april what about from then till dec when we apply?

2. Question 9.13 advises to list absences over the qualifying period is this every single time he has left the country includimg holidays and often when we go home we cross the border daily 😩 (he visits home lots due to poorly father) i thought this just used to be abesences over 6mths?

Hi,

I'll try to answer this the best i can with the knowledge i have.

1. You could try to include a financial statement with a covering letter explaining this is what has been earned minus the expenses and back it up with bank statements. Usually an accountant could make up company accounts detailing your profit and loss and expected earnings and what is going to be declared to HMRC for tax purposes.

2. Although anything 6 months or over should be mentioned, it is always maybe a good idea mention any prolonged time outside the UK even if it is less than 6 months and again back it up with evidence and an explanation just so it gives the case worker a better idea.

I hope this helps somewhat.

My contracted pay is £20k gross per year just gone up slightly.

Pay slip shows base pay as £1700 or thereabouts and then takes off pension contribution and also my childcare voucher schemr

But gross pay that is taxable shows £1300 or thereabouts as a result of the pension and the vouchers coming off which makes me look like I only make £16k

Which figure will they go with? Base pay or gross pay after those defuctions

I do have £27k in saving so should I include that?

Or should we just go with husbands self-employment which is around £33k but his bank statements are messy as he pays 15-20 worker?

I cannot comment on which financials you should present in with your application as that comes down to you, but whatever you decide to include do make sure there is evidence to present and clearly understandable.

If there are any discrepancies or variations, always have it backed up by an accountant and explanation.

Also regarding the payslips, UKVI always takes the gross pay (before any deductions) as your basic pay when looking for your income requirement.

So in this case you may need to include your contract and payslips that clearly show your gross pay and net.

My understanding is, and correct me if I'm wrong, UKVI looks for a minimum of £16,000 of saving that can used on top of any shortfall in income. So yes you can use that in your application.

My understanding is, you would only detail any journey in the application for period over 6 months or more. Unless it asks you for a shorter absence period, I don't think it will be necessary.

Again go with what the question asks, if it states 'any', then it would be advisable to mention it.Further clarification would be advised though.

Thanks for the quick reply.

I have a letter stating 20k and I also have a contract I can get printed that states that.

It’s just obviously my base pay equates to the 20k but worried they look at the wording gross pay which is at the top of my payslip which takes off pension and vouchers?

Also i’ve found out the question changed so have to declare all absenses on a spreadsheet and reasons?

Is it best to present the originals seperate from the copies or put each copy behind?
